Returns & Refund Policy

The circumstances under which products may be returned and refunds, replacements, or repairs may be provided by BuildGear Nigeria Limited.

Returns Notice

This policy should be read together with Buildgear's Terms and Conditions of Use and Sale. Customers should inspect products promptly upon delivery and report eligible issues within the stated claim period.

Introduction

1.1 At Buildgear Nigeria Limited, herein referred to as "Buildgear", "we", "our" or "us", customer satisfaction is important to us.

1.2 We are committed to supplying products that meet the specifications, quality standards and descriptions represented at the time of purchase.

1.3 This Returns and Refund Policy sets out the circumstances under which products may be returned and refunds, replacements or repairs may be provided.

1.4 This Policy should be read together with Buildgear's Terms and Conditions of Use and Sale.

Return Eligibility

2.1 Subject to this Policy, products may qualify for return where:

  1. An incorrect product was supplied
  2. The product was defective at the time of delivery
  3. The product arrived damaged due to transportation arranged by Buildgear
  4. The product materially differs from the description displayed on the website
  5. The product supplied does not substantially correspond with the order placed by the customer

2.2 Buildgear reserves the right to verify all return requests before approving any return, replacement, repair or refund.

Conditions for Return

3.1 Customers seeking to return a product must notify Buildgear within 72 hours from the date of delivery.

3.2 Returned products should, where applicable:

  1. Remain unused
  2. Be returned in their original packaging
  3. Include all accessories, manuals, labels and accompanying documentation
  4. Be accompanied by proof of purchase

3.3 Customers must take reasonable steps to preserve products pending inspection and return.

3.4 Where a return request is based on an allegation that the product was defective, damaged, incomplete, incorrect, materially different from the order placed, or otherwise non-conforming at the time of delivery, the requirement that the product be in resalable condition shall not apply. The customer shall, however, preserve the product substantially in the condition in which it was received and cooperate fully with any inspection, verification or investigation reasonably required by Buildgear.

3.5 Buildgear reserves the right to reject returns where products have been materially altered, modified, damaged through misuse, negligently handled or used contrary to manufacturer instructions.

Product Inspection Prior to Installation

4.1 Customers are required to inspect all products thoroughly upon delivery and before installation, assembly, commissioning, integration, modification or use.

4.2 Customers should verify, where applicable:

  1. Product specifications
  2. Quantity supplied
  3. Product dimensions
  4. Voltage ratings
  5. Model numbers
  6. Colour and finish
  7. Product compatibility with intended applications

4.3 Buildgear shall not be liable for defects, incompatibilities, shortages, incorrect specifications, visible damage or other issues that could reasonably have been identified through ordinary inspection prior to installation or use but were not reported before such installation or use occurred.

4.4 Installation, modification or use of a product may be treated as evidence that the customer accepted the product in its delivered condition, except in relation to latent defects not reasonably discoverable upon inspection.

Non-Returnable Products

Unless defective at the time of delivery, the following products shall generally not be eligible for return:

5.1 Installed Electrical Products

Including but not limited to:

  1. LED lighting products
  2. Smart lighting systems
  3. Switches
  4. Sockets
  5. Electrical fittings
  6. Solar lighting components

5.2 Special Orders

Products specially sourced, customised or manufactured to customer specifications.

5.3 Used Products

Including:

  1. Power tools
  2. Machinery
  3. Construction equipment
  4. Safety equipment
  5. Consumable products

5.4 Clearance and Promotional Items

Products sold as clearance, liquidation or promotional items, except where defective at the time of delivery.

Return Procedure

6.1 Customers seeking a return must contact Buildgear Customer Service within the applicable return period.

6.2 Customers may be required to provide:

  1. Order number
  2. Product details
  3. Description of the issue
  4. Photographs or videos
  5. Supporting documentation reasonably requested by Buildgear

6.3 Buildgear may require inspection of the product before authorising any return.

6.4 Products returned without prior authorisation may be refused.

Inspection and Investigation of Claims

7.1 Buildgear reserves the right to investigate and verify all claims relating to:

  1. Product defects
  2. Damage
  3. Shortages
  4. Missing components
  5. Incorrect specifications
  6. Delivery discrepancies

7.2 Buildgear shall determine, acting reasonably and in good faith, whether the alleged condition existed at the time of delivery or arose subsequently as a result of:

  1. Improper storage
  2. Mishandling
  3. Installation activities
  4. Alteration
  5. Negligence
  6. Misuse
  7. Other intervening causes

7.3 Buildgear may require independent technical assessment or manufacturer verification where appropriate.

Refunds

8.1 Where a refund is approved, Buildgear may process the refund through:

  1. Bank transfer
  2. Original payment method
  3. Store credit
  4. Any other mutually agreed method

8.2 Refund processing times may vary depending on financial institutions, payment processors and banking systems.

8.3 Buildgear shall use reasonable efforts to process approved refunds within five (5) to fourteen (14) working days.

8.4 Refunds shall not be payable where:

  1. The customer simply changes their mind after purchase
  2. The product has been used, altered or damaged after delivery
  3. The issue complained of falls outside this Policy

Replacement or Repair

9.1 Where appropriate, Buildgear may elect to:

  1. Replace the product
  2. Repair the product
  3. Issue a refund

9.2 The remedy provided shall depend upon the nature of the issue, product availability, manufacturer recommendations and commercial practicality.

Delivery Charges

10.1 Delivery charges are generally non-refundable.

10.2 Delivery charges may be refunded where:

  1. The wrong item was supplied
  2. The product was defective upon delivery
  3. The delivery error arose directly from Buildgear's fault

Limitation Period for Claims

11.1 Any claim relating to shortages, delivery discrepancies, damaged products, defects, refunds, replacements or any matter arising from a product purchase shall be submitted to Buildgear within 72 hours from the date of delivery.

11.2 Failure to notify Buildgear within the prescribed period may result in the claim being rejected except where prohibited by applicable law.

Limitation of Liability

12.1 To the fullest extent permitted by law, Buildgear shall not be liable for:

  1. Indirect losses
  2. Consequential losses
  3. Loss of profits
  4. Business interruption
  5. Project delays
  6. Labour costs associated with installation, removal or reinstallation of products

12.2 Buildgear's total liability arising under this Policy shall not exceed the purchase price paid for the affected product.

Severability

If any provision of this Policy is determined by a court of competent jurisdiction or other competent authority to be unlawful, invalid or unenforceable, such provision shall be severed and the remaining provisions shall continue in full force and effect.
