This policy should be read together with Buildgear's Terms and Conditions of Use and Sale and Returns & Refund Policy. Delivery timelines are estimates and may vary based on destination, accessibility, product type, logistics conditions, and other operational factors.

1.1 Buildgear Nigeria Limited, herein referred to as "Buildgear", "we", "our" or "us", is committed to ensuring the safe, efficient and timely delivery of construction materials, tools, machinery, electrical products, lighting solutions, safety equipment and related products throughout Nigeria.

1.2 This Shipping and Delivery Policy outlines the terms governing the processing, transportation and delivery of products purchased from Buildgear.

1.3 This Policy should be read together with Buildgear's Terms and Conditions of Use and Sale and Returns & Refund Policy.

Delivery Coverage

2.1 Buildgear provides delivery services throughout the Federal Republic of Nigeria.

2.2 Customers are required to provide complete, accurate and verifiable delivery addresses together with valid contact information to facilitate successful delivery.

2.3 Delivery availability, delivery timelines and applicable transportation charges may vary depending on:

  1. Delivery destination
  2. Accessibility of the delivery location
  3. Nature of the products ordered
  4. Security conditions
  5. Prevailing logistics and transportation circumstances

2.4 Certain remote or difficult-to-access locations may require additional delivery time, specialised transportation arrangements or additional charges.

Order Processing

3.1 In-Stock Products

Orders for products available in stock are generally processed within one (1) to three (3) business days after confirmation of payment.

3.2 Pre-Order Products

Certain products offered by Buildgear may be supplied on a pre-order basis depending on supplier availability, import schedules, manufacturing lead times or shipment schedules.

3.3 Estimated delivery timelines for pre-order products shall be communicated to customers before order confirmation.

3.4 Processing times are estimates only and may be affected by operational requirements, supplier delays, customs clearance procedures or other unforeseen circumstances.

4.3 Buildgear shall make reasonable efforts to deliver products within estimated timeframes but shall not be liable for delays beyond its reasonable control.

Delivery Charges

5.1 Delivery charges are determined based on factors including:

  1. Product weight
  2. Product dimensions
  3. Delivery destination
  4. Quantity ordered
  5. Special handling requirements
  6. Transportation arrangements required

5.2 Heavy, oversized or specialised products may attract additional transportation charges.

5.3 Delivery charges shall be communicated to customers before final order confirmation.

5.4 Buildgear reserves the right to revise delivery charges where inaccurate delivery information was provided or where additional logistics requirements become necessary.

Bulk Orders and Project Deliveries

6.1 For large-scale project orders or bulk purchases, Buildgear may arrange:

  1. Dedicated transportation
  2. Site delivery
  3. Scheduled deliveries
  4. Phased deliveries
  5. Multiple delivery consignments

6.2 Customers are encouraged to engage Buildgear's sales team to coordinate project-specific logistics requirements.

6.3 Buildgear reserves the right to determine the most suitable delivery method for bulk and project-related orders.

Delivery Requirements

7.1 Customers shall ensure that:

  1. Accurate delivery information is provided
  2. A responsible representative is available to receive products
  3. Delivery locations are accessible to delivery vehicles
  4. Contact telephone numbers remain active and reachable
  5. Appropriate offloading arrangements are available where necessary

7.2 Failure to satisfy these requirements may result in delivery delays, failed delivery attempts or additional charges.

7.3 Unsafe or Restricted Delivery Locations

Buildgear reserves the right to refuse, suspend, postpone, delay or cancel any delivery where the delivery location is reasonably considered unsafe, inaccessible, prone to violence, civil unrest, criminal activity, terrorism, kidnapping, armed conflict, communal disturbances, public disorder or any circumstance that may expose Buildgear, its employees, agents, contractors, vehicles, products or third parties to loss, damage, injury or undue risk.

7.4 Any delay, suspension, postponement, cancellation or inability to complete delivery arising from such circumstances shall constitute a Force Majeure event and Buildgear shall not be liable for any resulting loss, damage, cost, expense, inconvenience or delay.

Inspection Upon Delivery

8.1 Customers are required to inspect all products immediately upon delivery and prior to installation, assembly, commissioning, integration into any project or use.

8.2 Customers should verify:

  1. Product quantity
  2. Product specifications
  3. Product dimensions
  4. Visible damage
  5. Missing components
  6. Packaging condition
  7. Product compatibility where applicable

8.3 Any visible damage, shortage, incorrect specification, missing item or discrepancy reasonably discoverable upon inspection must be reported to Buildgear within 72 hours of delivery.

8.4 Customers may be required to provide photographs, videos or other supporting evidence to facilitate investigation of claims.

8.5 Failure to report discoverable issues within the prescribed period may affect the customer's entitlement to replacement, repair, refund or other remedies.

Failed Delivery Attempts

9.1 A delivery may be deemed unsuccessful where:

  1. The customer or recipient is unavailable
  2. The delivery address is inaccurate or incomplete
  3. Access to the location is unavailable
  4. Delivery is refused without valid reason
  5. Security conditions prevent completion of delivery

9.2 Additional delivery charges may apply for subsequent delivery attempts.

9.3 Buildgear reserves the right to cancel an order where repeated delivery attempts fail.

Risk and Ownership

10.1 Ownership and risk in products shall pass to the customer upon successful delivery and acceptance of the products.

10.2 Following delivery, customers shall be responsible for:

  1. Storage
  2. Handling
  3. Security
  4. Installation
  5. Maintenance
  6. Use of products

10.3 Buildgear shall not be responsible for damage occurring after risk has passed to the customer.

Delivery Delays

11.1 Buildgear shall not be liable for any delay, interruption or failure in delivery resulting from causes beyond its reasonable control including but not limited to:

  1. Traffic congestion
  2. Road closures
  3. Security concerns
  4. Fuel shortages
  5. Adverse weather conditions
  6. Flooding
  7. Civil disturbances
  8. Government actions
  9. Transportation breakdowns
  10. Labour disputes
  11. Acts of terrorism
  12. Force majeure events
  13. Other unforeseen operational circumstances

11.2 While Buildgear shall use reasonable efforts to notify customers of significant delays, delivery dates are estimates only and shall not constitute guaranteed delivery commitments.

Site Deliveries

12.1 For deliveries to construction sites or project locations, customers shall ensure:

  1. Clear site directions are provided
  2. Appropriate personnel are available to receive products
  3. Safe and suitable access routes are maintained
  4. Adequate offloading arrangements are available

12.2 Buildgear shall not be responsible for delays, damage or additional costs resulting from site restrictions, inadequate access, unsafe site conditions or failure to provide receiving personnel.

Damaged Goods in Transit

13.1 Where products transported by Buildgear arrive visibly damaged, customers should:

  1. Refuse acceptance where appropriate
  2. Record the damage on the delivery documentation
  3. Notify Buildgear within 72 hours
  4. Provide supporting photographic evidence where reasonably practicable

13.2 Buildgear reserves the right to inspect, investigate and verify all transit damage claims before approving replacement, repair or refund requests.

Electrical and Lighting Products

14.1 Customers must verify the specifications of electrical and lighting products before installation, including:

  1. Voltage ratings
  2. Wattage
  3. Colour temperature
  4. Product dimensions
  5. Model numbers
  6. Technical compatibility requirements

14.2 Buildgear shall not be liable for replacement costs, labour costs or project delays resulting from installation of products that were not inspected before installation.

Limitation Period for Claims

15.1 Any claim relating to delivery discrepancies, shortages, damaged goods, missing items, transportation issues or delivery-related complaints must be submitted to Buildgear within 72 hours from the date of delivery.

15.2 Failure to submit a claim within the prescribed period may result in the claim being rejected except where prohibited by applicable law.

Limitation of Liability

16.1 To the fullest extent permitted by law, Buildgear shall not be liable for:

  1. Indirect losses
  2. Consequential losses
  3. Loss of profits
  4. Project delays
  5. Business interruption
  6. Loss arising from customer failure to inspect products upon delivery
  7. Delays caused by events beyond Buildgear's reasonable control

16.2 Buildgear's aggregate liability arising from delivery services shall not exceed the amount paid by the customer in respect of the affected order.

Force Majeure

17.1 Buildgear shall not be liable for any delay or failure to perform delivery obligations arising from events beyond its reasonable control including:

  1. Natural disasters
  2. Floods
  3. Fire
  4. Government restrictions
  5. Civil unrest
  6. Transportation disruptions
  7. Fuel shortages
  8. Labour disputes
  9. Terrorism
  10. Epidemics or pandemics
  11. Power outages
  12. Internet failures
  13. Any other force majeure event

Severability

If any provision of this Policy is determined by a court of competent jurisdiction or other competent authority to be unlawful, invalid or unenforceable, such provision shall be severed and the remaining provisions shall continue in full force and effect.
